Terms and Conditions

These Terms and Conditions ("Terms") govern the provision of mentoring, coaching and performance consultations by The Winning Cox ("we," "us," or "our") to clients including, but not limited to, individual coxswains, rowing coaches, rowing clubs and organisations ("you" or "Client").

By engaging our services, you agree to be bound by these Terms.

1. Services

The Winning Cox provides professional mentoring and coaching consultations to support the development of coxswains and rowing programs. Services may include but are not limited to one-on-one sessions, group workshops, written feedback, or strategic guidance delivered remotely or in-person.

2. Session Booking

Sessions can be booked in one of the following ways:

  • Directly through our website

  • By email at thewinningcox@gmail.com

  • During a live consultation or coaching session

Booking confirmation will be provided by email along with any relevant session details or preparation instructions.

3. Payment Terms

  • All invoices must be paid in full 24 hours prior to the scheduled consultation unless otherwise agreed in writing.

  • Accepted payment methods include bank transfer and PayPal.

  • Bank details or PayPal instructions will be provided on the invoice.

  • Late payments may result in rescheduling or suspension of services until payment is received.

4. Travel Costs

  • All listed consultation fees apply to services only and do not include travel costs.

  • Where travel is required, expenses such as transportation, accommodation, and subsistence will be quoted on an individual basis in advance.

  • Travel costs will be added to your invoice and are payable in full alongside the session fee.

  • Travel arrangements will be discussed and agreed upon before any commitment is made.

5. Cancellations and Refunds

  • Clients must give at least 48 hours’ notice to reschedule a consultation. Cancellations with less than 48 hours’ notice may incur the full session fee.

  • Refunds are not provided for completed services. Any exception to this policy will be at our sole discretion.

  • You can cancel or reschedule via email at thewinningcox@gmail.com. By booking a session, you agree to the terms of this cancellation policy.

6. Force Majeure

  • If performance of The Winning Cox’s obligations is delayed or hindered by circumstances outside The Winning Cox’s control amounting to Force Majeure, the following provisions in this section shall apply.

  • The Winning Cox shall not be liable for any delay, interruption, or failure to deliver mentoring services resulting from circumstances beyond its reasonable control. This includes, but is not limited to, severe weather, illness or injury, transport disruption, power outages, government restrictions, or other unforeseeable events ("Force Majeure Events").

    In the event of a Force Majeure Event:

    • Clients will be notified as soon as reasonably possible.

    • Sessions affected will be rescheduled at a mutually agreed time, subject to availability.

    • No refunds will be issued for cancellations due to Force Majeure; however, the client will retain the right to reschedule the missed session(s) at no additional cost within 3 months of the original booking.

    • If rescheduling is not feasible due to continued disruption, credit may be issued at the discretion of The Winning Cox.

7. Refund Policy

  • No refunds will be issued for completed sessions or late cancellations.

  • For prepaid packages, any unused sessions may be rescheduled within the validity period but are non-refundable. 

8. Intellectual Property

  • All materials, methodologies, session content, and resources shared during consultations are the intellectual property of The Winning Cox.

  • You agree not to copy, share, reproduce, distribute, or use any part of the consultation content or related materials outside of the intended consulting environment without express written permission.

  • This includes, but is not limited to: training frameworks, strategic advice, documents, audio/video resources, and session recordings.

9. Confidentiality

We respect your privacy and treat all discussions and shared materials as confidential. Likewise, you agree not to disclose any proprietary insights or information obtained during consultations to third parties.

10. Limitation of Liability

The Winning Cox provides mentoring and advice based on experience and professional judgment. However, we make no guarantees regarding specific performance outcomes. We are not liable for any direct, indirect, or consequential loss arising from the use of our services. By engaging in our services you , the client, acknowledge that you are fully responsible for their own progress, decisions, and actions during and after coaching sessions. Coaching is not a substitute for professional advice from legal, medical, financial, or mental health professionals. Always seek the appropriate help when needed.

11. Termination of Services

Either party may terminate the coaching relationship at any time with written notice. Refunds will not be issued for booked sessions unless otherwise agreed upon.​

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. By engaging in coaching services with The Winning Cox you acknowledge that you have read, understood, and agree to these Terms and Conditions.

13. Amendments

We reserve the right to update or amend these Terms at any time. Continued engagement with our services following any changes constitutes your acceptance of the updated Terms.
